Types of Property Licenses in England


There are three types of property licenses in England that Fraser & Co need to be aware of:

Mandatory HMO Licensing: 

This type of licensing applies to any House in Multiple Occupation (HMO) in England where five or more people, from two or more households, share facilities such as a kitchen, bathroom, or toilet.

The property must meet the standard test, self-contained flat test, or converted building test HMO definition under Section 254 of the Housing Act 2004. 

To apply for a mandatory HMO license, Fraser & Co should submit a license application to the local council using their prescribed application process.



Additional Licensing: This type of licensing applies to certain HMOs that fall outside the mandatory HMO licensing scheme. 

The council will decide what type of HMOs need a license within the designated area.

Selective Licensing: This type of licensing also only applies in certain areas of England.

Exemptions

There are exemptions from HMO licensing, including buildings managed by a local housing authority, properties occupied by just two people who form two households, and buildings already regulated under certain other statutory provisions.
